1.Agreement to terms

By providing your mobile phone number and signing a consent form, or by continuing to receive SMS notifications from Conger Meat Market ("we," "our," or "the Company"), you agree to be bound by these Terms and Conditions. If you do not agree, you may opt out at any time as described in Section 7 below.

These Terms govern only the automated SMS alert program used to monitor cooler and freezer units in our retail store, with alerts delivered via the Twilio messaging platform. They do not govern any other products, services, or communications provided by Conger Meat Market.

2.Program description

Conger Meat Market operates an automated temperature and equipment monitoring system covering the cooler and freezer units on our retail store floor. The system continuously measures and records temperature readings and refrigeration unit performance to protect product integrity, food safety, and regulatory compliance.

This program is strictly operational in nature. No promotional, marketing, or commercial messages will be sent through this system.

3.Eligibility

Participation in this SMS program is limited to:

• Current employees and authorized personnel of Conger Meat Market
• Individuals who have completed and signed the Company's SMS Notification Consent Form
• Individuals who are the account holder or authorized user of the mobile number provided

By enrolling, you represent that you meet all of the above criteria. You agree to notify the Company promptly if your mobile number changes or if you are no longer the account holder for the number on file.

4.Message frequency

Message frequency is variable and depends entirely on conditions in the retail store coolers and freezers. Under normal operating conditions you may receive few or no messages. During temperature exceedances, equipment faults, or sensor anomalies, alert frequency may increase until the condition is resolved.

Conger Meat Market does not guarantee any minimum or maximum number of messages per day, week, or month. Messages are sent only when automated monitoring thresholds are triggered.

5.Costs & carrier charges

Conger Meat Market does not charge recipients for participation in this SMS notification program. However, standard message and data rates from your mobile carrier may apply. These charges are your responsibility. Please contact your carrier for details regarding your plan's messaging rates.

The Company is not responsible for any fees, charges, or costs imposed by your mobile carrier in connection with receipt of these messages.

6.Supported carriers

Messages are delivered via Twilio's SMS platform and are compatible with all major U.S. mobile carriers. However, the Company cannot guarantee delivery to all devices or carrier networks under all circumstances. Delivery may be affected by carrier policies, network availability, device settings, or other factors outside our control.

Conger Meat Market is not liable for missed, delayed, or undelivered messages caused by carrier or network conditions.

7.How to opt out

Your participation is voluntary. You may withdraw consent and stop receiving SMS alerts at any time by:

• Notifying your supervisor or store manager in writing
• Submitting a written opt-out request to the contact listed in Section 11

Upon receipt of your opt-out request, your mobile number will be removed from the notification system within a reasonable timeframe. Please note that opting out may impact your ability to receive time-sensitive temperature alerts relevant to your duties.

Re-enrollment requires completion of a new consent form.

8.Your responsibilities

By participating in this program, you agree to:

• Provide an accurate mobile number for which you are the account holder or authorized user
• Notify the Company promptly if your contact number changes
• Use the information contained in alerts responsibly and in accordance with your job duties
• Not share, forward, or redistribute alert content in any manner that violates Company policy or applicable law

Conger Meat Market reserves the right to modify, suspend, or terminate this SMS notification program at any time without prior notice. We may also update these Terms and Conditions at any time. The "Last Updated" date at the top of this page will reflect any revisions. Continued participation following an update constitutes acceptance of the revised Terms.

The Company may remove any participant from the program at its discretion, including in cases where the enrolled number is no longer valid or the individual is no longer an authorized employee or personnel member.
